We want you to fully understand your rights and our rights regarding the provision of the Services (as defined below). Please review these Terms carefully before using our Services.

RoadbookRally’s Services and Role

What we do

We offer an events and tracks management and engagement platform designed to help rally and navigation event Organizers and participants thrive by connecting through memorable live or online experiences. Using our Services, Organizers can create, schedule, and oversee their navigation events and tracks, manage registrations, collect payments (if desired), and stay connected to participants through our suite of tracking and management tools.

How we fit in

RoadbookRally itself is not the creator, organizer, or owner of the events or tracks you see on our platform. Nor do we serve as the direct seller of entr fees, registrations or merchandise. Instead, we provide the Services that enable Organizers to manage their events and tracks, process registrations or entry fees, and promote those events and tracks to participants.

When you host an event or track, you (the Organizer) bear sole responsibility for ensuring the event and its associated page comply with all relevant laws, rules, and regulations, and that any goods or services sold or described are accurate and delivered as promised.

You and RoadbookRally agree as follows:

By using RoadbookRally, you automatically agree to these Terms, so the first thing you should do is read them carefully. If you don't wish to accept all of these Terms then please don't use our service.

• RoadbookRally provides the Services and RoadbookRally Technology “AS IS” and “AS AVAILABLE”.
• We can't guarantee the continuous, uninterrupted or error-free operation of the service.
• You guarantee that you own the content that you provide/upload on the RoadbookRally platform.
• RoadbookRally is not liable for any data loss of content.
• RoadbookRally may modify the RoadbookRally Services at any time, including adding or removing functionality or imposing conditions on use of the RoadbookRally Services.
• It is restricted to copy, reproduce, republish, upload, post, transmit, resell, or distribute in any way, any part of the Services, Documentation, or the RoadbookRally Website except as permitted by Law.
• RoadbookRally may suspend or terminate your access to any Services at any time.
• RoadbookRally assumes no responsibility for any errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication line failures, unauthorized access to, or theft, destruction, or alteration of content.
• RoadbookRally is not responsible for any problems or technical malfunctions of telephone networks or lines, computer online systems, servers or providers, computer equipment, software, or any technical problems or congestion on the Internet and/or in the RoadbookRally services.
• The RoadbookRally services are provided "as is" and without any warranty. RoadbookRally does not guarantee that the RoadbookRally services will be uninterrupted, secure, or free of bugs at all times. RoadbookRally disclaims all warranties regarding the suitability of the RoadbookRally services for a particular purpose. Furthermore, RoadbookRally does not guarantee specific results from using the RoadbookRally services.
• The RoadbookRally fees can be changed at any time without warning.
• RoadbookRally is not responsible for any incorrect or inaccurate content provided through the RoadbookRally services.
• Publication of content via RoadbookRally does not violate privacy rights, publicity rights, copyrights, contract rights or other rights of third parties.
• Before you make a purchase decision you are advised to try RoadbookRally for free.
• You agree that upon purchasing our service, that you clearly understand and agree what you are purchasing and will not file a fraudulent dispute.
• You won’t bring us into any disputes between you and a third party.
• You agree to have our back if a third party comes after us because of something you did or failed to do.
• It is your sole responsibility to check whether the Terms of Service have changed.
• We reserve the right to modify, suspend or withdraw the whole or any part of our service or any of its content at any time without notice and without incurring any liability.

Entry Fees; Services Fees; Taxes.

• When you pay the entry fee, you gain the right to access the track, roadbook, or event organized by the respective organizer. However, you do not own the track, roadbook, or event. The entry fee is transferred to the corresponding organizer.
• The Service Fees are stated on the RoadbookRally Pricing Page, unless you and RoadbookRally otherwise agree in writing. RoadbookRally may revise the Fees at any time.
• Collection of Fees and Other Amounts: You must pay, or ensure that RoadbookRally is able to collect, Fees and other amounts you owe under this Agreement when due.
• Track and Event entry fees exclude all Taxes. Track and event entry fees are not subject to VAT. The RoadbookRally service fees (including service fee taxes) are deducted from the entry fees before the transfer. You have sole responsibility and liability for:
• (a) determining which, if any, Taxes or fees apply to the sale of your products and services, acceptance of donations, or payments you make or receive in connection with your use of the Services; and
• (b) assessing, collecting, reporting and remitting Taxes for your business. If RoadbookRally is required to withhold any Taxes, RoadbookRally may deduct those Taxes from amounts otherwise owed to you and pay those Taxes to the appropriate taxing authority. If you are exempt from paying, or are otherwise eligible to pay a reduced rate on, those Taxes, you may provide to RoadbookRally an original certificate that satisfies applicable legal requirements attesting to your tax-exempt status or reduced rate eligibility, in which case RoadbookRally will not deduct the Taxes covered by the certificate. You must provide accurate information regarding your tax affairs as RoadbookRally reasonably requests, and must promptly notify RoadbookRally if any information that RoadbookRally prepopulates is inaccurate or incomplete. RoadbookRally may send documents to you and taxing authorities for transactions processed using the Services. Specifically, Law may require RoadbookRally to file periodic informational returns with taxing authorities related to your use of the Services. RoadbookRally may send tax-related information electronically to you.
• The platform operator (RoadbookRally) must collect VAT on the goods or services sold to the customer (where applicable)
• To protect from fraudulent activity, RoadbookRally reserves the right to delay payout payments of your earnings for up to 120 days from the date of the transaction.

Refunds

• Tracks: The track entry fee payee is eligible for a refund if the track is physically closed, un-drivable due to road closures or similar issues, or becomes unavailable on the RoadbookRally platform. Contact the track organizer to issue a refund. No refunds are granted for unused entries and entry fees older than 120 days.

• Events: each Event has its own refund policy, contact the Event organizer for details.

• Consumers requesting a refund should contact the event or track Organizer. Not RoadbookRally directly.

  Since all transactions occur between an Organizer and Consumers, we require Consumers to direct any refund requests to the applicable Organizer.

  If you receive a refund as a Consumer, you are not permitted to attend the event or track. Violating this policy constitutes fraud.

Suspension.

RoadbookRally may immediately suspend providing any or all Services to you, and your access to the RoadbookRally Technology, if:

• (a) RoadbookRally believes it will violate any Law, Financial Services Terms or Governmental Authority requirement;
• (b) a Governmental Authority or a Financial Partner requires or directs RoadbookRally to do so;
• (d) you do not respond in a timely manner to RoadbookRally’s request for User Information or do not provide RoadbookRally adequate time to verify and process updated User Information;
• (e) you breach this Agreement or any other agreement between the parties;
• (h) RoadbookRally believes that you are engaged in a business, trading practice or other activity that presents an unacceptable risk to RoadbookRally; or
• (i) RoadbookRally believes that your use of the Services (i) is or may be harmful to RoadbookRally or any third party; (ii) presents an unacceptable level of credit risk; (iii) increases, or may increase, the rate of fraud that RoadbookRally observes; (iv) degrades, or may degrade, the security, stability or reliability of the RoadbookRally services, RoadbookRally Technology or any third party’s system (e.g., your involvement in a distributed denial of service attack);
• (v) enables or facilitates, or may enable or facilitate, illegal or prohibited transactions; or (vi) is or may be unlawful.

Track Usage Disclaimer:

RoadbookRally does not take responsibility for any track conditions and explicitly states that the tracks are not designed for riding in competition mode. You have to follow traffic and any other laws. RoadbookRally services and tracks are solely intended for training and ride analysis purposes. Participants must use the tracks accordingly or not use them at all, and acknowledge that RoadbookRally will not be liable for any incidents or liabilities arising from any type of services, track and/or event usage. Tracks (roadbooks and GPX trails/routes) are provided 'as is'. Not all details and/or dangers are marked, so do not follow them blindly. Use your own judgment, as you and you alone are responsible for your actions.

Consumer Information.

We expect you to follow the rules when dealing with information about Consumers. If you are an Organizer, you must always comply with all applicable local, state, provincial, national, and other laws, rules, and regulations regarding the information you collect from (or receive about) Consumers or other individuals. You must also follow any policies we post on our Services regarding that information.

Additional Legal Disclaimer:

I participate at my own risk and will not hold the Event Organizers, Track owners, officials, or RoadbookRally.com (SIA Roadbook Rally) responsible for any material damages or personal injuries I may suffer due to incidents and/or accidents while using the RoadbookRally services or applications. I accept full civil, administrative, and criminal responsibility. Tracks (roadbooks and GPX trails/routes) are provided 'as is.' Not all details and/or dangers are marked, so do not follow them blindly. Use your own judgment, as you and you alone are responsible for your actions.

RoadbookRally services user's Responsibility and Liability:

Responsibility:

RoadbookRally Users/Participants (including entrants, competitors, drivers, passengers, owners, and owner-drivers of vehicles) engage in the provided services at their own risk. They bear full responsibility under civil and penal codes for any damages caused by them or their vehicles. If a user/participant driving a vehicle is not the owner or registered owner-driver, he or she absolves the aforementioned owners from all claims related to vehicle use during the event.

Liability Waiver:

By submitting the RoadbookRally registration form, users waive all rights to legal actions and claims for any incidents or damages against: The track owner/event organizer/promoter/RoadbookRally.com (SIA Roadbook Rally), and their representatives, stewards, and assistants. Other participants, their attendants, and their own assistants. This agreement becomes effective upon submission of the registration form. By registering, I affirm that I commit to adhere strictly to these terms. I agree to abide by all governing laws. No complaints will be entertained regarding the format, availability, or use of the RoadbookRally website, RoadbookRally mobile applications, electronic roadbooks, tracks, events.

Terms of Service

The RoadbookRally websites, along with related mobile apps and services (together called the “Services”), are provided under these Terms of Service (the “Terms”). The Services are offered by SIA Roadbook Rally (referred to as “RoadbookRally” or “we” in these Terms). By using the Services, you agree to follow these Terms and any extra terms that RoadbookRally may post on the Services (which become part of these Terms). RoadbookRally may review accounts and user actions on the Services to confirm they follow these Terms.

By agreeing to these Terms, you confirm that you have read and agree to the Privacy Policy and Cookie Statement, which apply to all Users. These policies are part of these Terms by reference.

Users may also be bound by the following additional terms, which are incorporated by reference into these Terms: A. If you are an Organizer, Eventbrite’s Merchant Agreement and Organizer Refund Policy Requirements apply to you.

BY ACCESSING, USING, UPLOADING, OR DOWNLOADING ANY INFORMATION OR MATERIALS THROUGH THE SERVICES, OR BY SHOWING YOUR AGREEMENT TO THESE TERMS (FOR EXAMPLE, BY CREATING AN ACCOUNT OR CLICKING “SIGN UP”), YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.

If you access or use the Services on behalf of a company or another entity, you confirm that you have the authority to bind that entity and its affiliates to these Terms, making them fully binding. In this case, "you" refers to the entity and its affiliates. If you do not have the required authority, you are not permitted to access or use the Services. These Terms include disclaimers of warranties and limitations of liability that may apply to you.

Registration and Accounts

The Services are intended only for individuals who are at least 13 years old or the minimum age required in your country to use them. If you are below the legal age to enter a binding contract in your jurisdiction, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

If you are a parent or legal guardian of a RoadbookRally user who is under the legal age to enter a binding contract in your jurisdiction, you agree to take full responsibility for their actions or omissions, including any violations of these Terms. However, RoadbookRally reserves the right, at its sole discretion, to deny access to the Services for users under certain ages, even if they meet the legal age requirement.

To use the Services, you must register and agree to: (a) provide true, accurate, current, and complete information about yourself (“User Data”) and (b) maintain and promptly update your User Data. You acknowledge that RoadbookRally may use your User Data to provide the Services you access or use, as outlined in these Terms and our Privacy Policy. You also agree to create only one account for personal use and not share your account or RoadbookRally subscription with others. All activities associated with your account must reflect actions genuinely taken by you. If you provide inaccurate or outdated User Data, create multiple accounts, or if RoadbookRally has reasonable grounds to believe your User Data is incorrect or not current, RoadbookRally may suspend or terminate your account and deny current or future access to the Services. By using the Services, you confirm that you are not prohibited from receiving services under the laws of any applicable jurisdiction.

You are solely responsible for keeping your account password confidential and for restricting access to your password, computer, and mobile device while logged into the Services. You accept full responsibility for all activities that occur under your account or from your devices. You agree to immediately notify RoadbookRally of any unauthorized use of your account or password, or any other security breach. You also acknowledge the risks of unauthorized access to your User Data and any other information or content you provide to RoadbookRally. For security reasons, the use of unique and complex passwords is highly recommended.

You may register for or log in to your account using a third-party network, such as Facebook, Google, or Apple. By doing so, you authorize RoadbookRally to pre-populate registration and other relevant information fields of your account and/or use your third-party credentials for login, in accordance with those companies’ privacy policies. If you connect your account to a third-party network, you agree to comply with the applicable terms, conditions, and policies of that third party.

Because certain Services connect to third-party APIs, you agree to be bound by the terms of service and privacy policies of those providers when using such Services.

Payments and Fees

To pay any fee, you must provide details of your preferred payment method (e.g., credit card, online payment service, a third-party platform like Apple App Store or Google Play, or any other method offered by RoadbookRally) (the “Payment Method”). By providing payment information, you authorize RoadbookRally and certain third-party service providers, payment card networks, and payment processors to receive, store, and encrypt your payment details.

RoadbookRally does not offer refunds or credits except as stated in these Terms. If your payment provider detects fraudulent charges on your account related to your Payment Method used on the Services, contact us immediately at [email protected].

Beta Features RoadbookRally may offer certain features as part of a beta release, early access program, or similar opportunity to test new functionality ("Beta Features"). These Beta Features may not be fully supported and may require you to update your version of the Services. Use of Beta Features is at your own risk, and you acknowledge that they may contain errors, design flaws, or other issues. RoadbookRally may modify or discontinue Beta Features at any time without notice.

Ownership of and Use of Content You own or have the necessary rights to grant the permissions outlined in these Terms for any information, data, text, software, sound, photographs, graphics, video, messages, posts, tags, or other materials you make available through the Services (“Content”), whether publicly posted, privately transmitted, or submitted via a third-party API. Public events and tracks created using the Services are not considered Content. By using the Services, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and display any Content, along with any name, username, or likeness you post in connection with the Services. This applies across all media formats and channels, now known or developed in the future, without compensation to you. This license terminates when you delete your Content or your account.

You agree that RoadbookRally is not responsible for and does not endorse any Content posted on the Services. If your Content violates these Terms or applicable laws, you may be legally responsible for it. Between you and RoadbookRally, any Content you provide is considered non-confidential and non-proprietary, and we are not liable for its use or disclosure. You acknowledge that your relationship with RoadbookRally is not confidential, fiduciary, or otherwise special. Your decision to submit Content does not place RoadbookRally in a different position from the general public regarding your Content. Except as outlined in our Privacy Policy and your privacy settings, RoadbookRally has no obligation to keep your Content confidential and is not liable for any use or disclosure of it.

The Services allow you to designate certain Content you submit as private, public, or accessible only to select users. RoadbookRally will respect and maintain the privacy of your Content based on your chosen settings. However, if you do not mark your Content as private or restricted to a limited group, or if you later change its designation to make it publicly available, you are responsible for its public visibility. For more details on managing your privacy settings, please review our Privacy Policy.

You grant us permission to use your profile name, profile photo, and information about your activities and actions, including your use of third-party products, services, or devices, in ads, offers, and other commercial contexts on the Services without compensation to you.

You understand that using certain features of the Services may require purchasing third-party equipment or materials (e.g., GPS systems). While RoadbookRally may recommend products from specific third-party suppliers, it is not responsible for your acquisition or use of such equipment or materials. RoadbookRally does not guarantee that third-party equipment or materials will be compatible with the Services or free from errors.

You understand that you are responsible for any charges incurred when sending communications through your device. You also acknowledge that you have the right to communicate with your contacts via the Services.

You represent and warrant that: (i) You are authorized to create your account, whether for yourself or on behalf of an organization. (ii) You own the Content you post on or through the Services or have the necessary rights to grant the licenses outlined in these Terms. (iii) Your Content does not and will not violate, misappropriate, or infringe on any third-party rights, including but not limited to privacy and data protection rights, publicity rights, copyrights, trademarks, or other intellectual property rights. (iv) You agree to pay any royalties, fees, or other costs associated with the Content you post on or through the Services.

Content and Conduct Restrictions

You understand that you, not RoadbookRally, are solely responsible for any Content you upload, post, email, transmit, or otherwise make available through the Services. In accordance with applicable law, RoadbookRally may screen, monitor, hide, restrict, refuse, or remove any Content that violates these Terms or is otherwise objectionable. However, this does not guarantee the accuracy, integrity, or quality of such Content. By using the Services, you acknowledge that you may encounter Content that is offensive, indecent, objectionable, or illegal. You agree to assume all risks associated with accessing and using such Content, including reliance on its accuracy, completeness, or usefulness. If you believe any Content on the Services violates our standards or these Terms, please report it to us. For more details on actions RoadbookRally may take against accounts violating these Terms and what to do if you believe an action was taken in error, please refer to our policies.

Interactions with RoadbookRally Users

The Services act as a platform to connect RoadbookRally users in a virtual space. As a neutral facilitator, RoadbookRally is not directly involved in interactions between users. Therefore, RoadbookRally does not control the truth, accuracy, quality, legality, or safety of user postings.

RoadbookRally is not responsible for verifying the identity, qualifications, background, or abilities of users. You should always use common sense and good judgment when interacting with others on the platform.

If you choose to use features that notify your contacts about the Services, track activities via RoadbookRally systems, or share information with others, RoadbookRally may require contact information. By providing this information, you confirm that you are authorized to do so and that RoadbookRally may use it to send emails or text messages on your behalf. RoadbookRally will process this information in accordance with its Privacy Policy.

Third Parties

Third-party products and services available on the Services are offered directly by the respective third parties. When you pursue or purchase any such product or service, you acknowledge that you are entering into a contract directly with the third party, not with RoadbookRally.

Your interactions with or participation in third-party promotions, including payments, delivery of goods or services, and any associated terms, are solely between you and the third party. You are not required to engage with any third party that appears on the Services.

YOU AGREE THAT ROADBOOKRALLY SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGES OF ANY KIND RESULTING FROM YOUR DEALINGS WITH THIRD-PARTY SERVICE PROVIDERS OR ADVERTISERS THROUGH THE SERVICES.

RoadbookRally or third parties may provide links to external websites or resources. RoadbookRally does not endorse, control, or take responsibility for any content, information, advertisements, products, or materials available from such sites or resources. You acknowledge and agree that RoadbookRally is not responsible for the availability or reliability of these external sites or resources.

Electronic Communications

The Services may allow you to send or post messages and communications to third-party service providers, advertisers, personal contacts, other users, and RoadbookRally. You agree to use these communication methods only for their intended purpose as provided by RoadbookRally. Any communications you send will be considered your Content and will be subject to these Terms and applicable laws, including those regulating direct marketing communications.

By using the communication features on the Services, you agree that:

(a) Depending on your account settings and the method of communication, your messages may be public rather than private. (b) Communications sent to or received from third-party service providers, advertisers, or other third parties are not endorsed, sponsored, or approved by RoadbookRally unless explicitly stated otherwise. (c) RoadbookRally may, as permitted by law, pre-review, post-review, screen, archive, or otherwise monitor communications.

You also agree that all notices, disclosures, and other communications provided electronically by RoadbookRally satisfy any legal requirement that such communications be in writing.

Proprietary Rights

You acknowledge and agree that the Services, any related software, aggregated data based on Content, and any Content available on the Services contain proprietary and confidential information protected by applicable intellectual property and other laws. Unless expressly permitted by law or authorized by RoadbookRally or relevant third parties, you agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the Services, software, or Content (except for Content you submit), in whole or in part.

RoadbookRally grants you a limited, personal, revocable, non-transferable, non-sublicensable, and non-exclusive right to access and use the Services, provided that you do not (and do not allow others to) copy, modify, create derivative works from, reverse engineer, reverse assemble, or attempt to discover the source code. You may not sell, assign, sublicense, grant a security interest in, or transfer any rights in the Services, except where permitted by law. You agree to access the Services only through the interfaces provided by RoadbookRally.

Your Feedback

You may have the ability to provide comments, feedback, suggestions, ideas, original or creative materials, and other communications related to the Services (collectively, “Feedback”).

By providing Feedback, you grant RoadbookRally a worldwide, non-exclusive, transferable, assignable, sub-licensable, perpetual, irrevocable, and royalty-free license to copy, distribute, create derivative works, publicly display and perform, and otherwise use such Feedback. Additionally, RoadbookRally has the right to use, make, have made, sell, offer for sale, import, and export products and services based on your Feedback.

For this reason, do not submit any Feedback that you do not wish to license to RoadbookRally under these terms.

Disclaimer of Warranties and Liability

The Services, including all information, software, products, services, and content, are provided "as is" without any warranties. RoadbookRally and its subsidiaries, affiliates, officers, employees, agents, partners, and licensors disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

RoadbookRally does not guarantee that: (a) The Services will meet your requirements. (b) Your Content will always be available, or that the Services will be uninterrupted, timely, secure, or error-free. (c) The results obtained from using the Services will be accurate or reliable. (d) The quality of any products, services, information, or other materials purchased through the Services will meet your expectations. (e) Any errors in the Services will be corrected.

No Medical Advice You expressly agree that RoadbookRally does not provide medical advice through the Services. Any content available—including text, images, videos, and other materials—is not a substitute for:

Advice from a physician or other medical professional. A visit, call, or consultation with a medical professional. Information found on product packaging or labels.

If you have any health-related concerns, contact a healthcare provider immediately. In case of an emergency, call your physician or 112 (in Europe), or 911 (if in the U.S. or Canada). You should never disregard or delay seeking medical advice due to any content available on the Services. The use of Services does not establish a doctor-patient or healthcare provider relationship between you and RoadbookRally.

Athletic Risks & Waiver of Liability You acknowledge that participating in athletic and sporting activities (e.g., riding) carries risks, including property damage, injury, or death. You voluntarily assume all risks, even if caused in part by RoadbookRally's negligence or the actions of others.

RoadbookRally does not assume responsibility for supervising, inspecting, or organizing any race, contest, challenge, or group activity that uses the Services, including those organized by a club administrator.

By using the Services, you release RoadbookRally and its subsidiaries, affiliates, officers, agents, employees, partners, and licensors ("Released Parties") from any liability related to:

Your athletic activities. Your use of RoadbookRally websites, apps, content, services, or products (including training plans, tracks or events). Any claims, injuries, damages, or losses arising from such use. Any direct, indirect, punitive, incidental, special, or consequential damages related to: Your use or misuse of the Services. Your use or misuse of equipment or programs created or licensed by RoadbookRally. Your interactions with third-party service providers or advertisers. Delays, inaccessibility, or errors in the Services. Information, software, products, services, or content obtained through the Services. These limitations apply regardless of legal theory (contract, tort, strict liability, etc.), even if RoadbookRally has been advised of possible damages.

No Endorsement of User Content RoadbookRally does not endorse any user content, including yours or other users’, and disclaims liability for any loss, damage, injury, or claims resulting from such content.

Licenses and Permits Organizers Must Obtain

Organizers must secure all necessary licenses, permits, and authorizations for their events and tracks.

If you are an Organizer, in addition to your other representations and warranties, you represent and warrant to us that:

• You will obtain, before starting entry fee sales, all necessary licenses, permits, and authorizations (individually and collectively, “Licensure”) for your RoadbookRally events and tracks. Licensure includes any required state, county, municipal, or other local authority’s authorization of the event and track, traffic engineering authorizations, fire department inspection reports, fire marshal permits, authorization to receive minors, sanitary authorization, and property operation permits.

• You will comply, and ensure that the venues for your RoadbookRally events and tracks comply, with all applicable laws, regulations, rules, and ordinances.

• You will maintain, throughout your use of the Services, the necessary Licensure to promote, produce, sponsor, host, and sell entries for your RoadbookRally events and tracks.

• You will provide evidence of Licensure and related information before offering entries or registrations for your RoadbookRally events and tracks, and promptly upon our reasonable request.

Scraping or Commercial Use of Site Content Is Prohibited

You may not use our content for commercial purposes.

You are not permitted to use any Site Content for your own commercial purposes. Additionally, you agree not to scrape, crawl, or use automated methods to extract data from the platform.

Indemnity

You agree to indemnify and hold harmless RoadbookRally, along with its subsidiaries, affiliates, directors, officers, agents, representatives, employees, partners, and licensors, from any claims or demands, including reasonable attorneys’ fees, made by any third party due to or arising from:

Content you submit, post, transmit, or make available through the Services. Your use of the Services. Your athletic activities that generate the Content you post or attempt to post on the Services, including but not limited to activities related to contests, races, group rides, or events, tracks that RoadbookRally sponsors, organizes, participates in, or is used for. Your connection to the Services. Your violation of these Terms. Your violation of any data protection or privacy laws. Your violation of another person’s or entity’s rights.

Access to or use of the Content or the Services from territories where such access or use is illegal is prohibited. Those who choose to access the Services do so on their own initiative and are responsible for compliance with applicable local laws.

Termination

You agree that RoadbookRally may, under certain serious circumstances and without prior notice, immediately suspend or terminate your account and/or access to the Services.

Causes for Suspension or Termination Suspension or termination may occur for reasons including, but not limited to: (a) Violating these Terms or other incorporated agreements, policies, or guidelines. (b) Requests from law enforcement or government agencies. (c) A request by you (self-initiated account deletion). (d) Discontinuation or significant modification of the Services (or any part thereof). (e) Unexpected technical or security issues. (f) Extended inactivity on your account. (g) Nonpayment of fees owed in connection with the Services.

Effects of Termination If your account is terminated, the following actions may occur: (x) Loss of access to all Services and offerings. (y) Deletion of your information, files, and Content associated with your account. (z) Permanent restriction from using the Services in the future.

All account suspensions or terminations will be made at RoadbookRally’s sole discretion, and RoadbookRally will not be liable to you or any third party for any resulting losses.

The following Sections shall survive termination of your account and/or the Terms: Content and Conduct, Proprietary Rights, Your Feedback, Disclaimer of Warranties and Liability, Indemnity, Choice of Law and Forum, and General.

RoadbookRally Merchant Agreement

If you are an event or track Organizer, you must comply with the RoadbookRally Merchant Agreement.

General

You agree that no joint venture, partnership, joint controllership, employment, or agency relationship exists between you and RoadbookRally as a result of these Terms or your use of the Services.

Entire Agreement & Enforceability These Terms constitute the entire agreement between you and RoadbookRally regarding your use of the Services. The failure of RoadbookRally to exercise or enforce any right or provision in these Terms does not constitute a waiver of that right or provision.

Assignment & Transfer You may not assign, delegate, or transfer your account or any obligations under these Terms without prior written consent from RoadbookRally. RoadbookRally may, at its sole discretion, transfer or assign any or all of its rights under these Terms. RoadbookRally may also delegate or use third-party contractors to fulfill its duties and obligations under these Terms and in connection with the Services. Notices & Communication RoadbookRally’s notice to you via email, regular mail, posts, or links on the Services shall constitute valid notice under these Terms. A printed version of the Terms and any electronic notice shall be admissible in judicial or administrative proceedings, just like other business documents originally created in printed form.

RoadbookRally and its third-party service providers may make improvements, updates, and changes to the Services, including products, mobile applications, features, programs, and pricing, at any time and for any reason at its sole discretion. For example, the mobile application may automatically download and install upgrades, updates, and additional features to improve and further develop the Services. Modification or Discontinuation of Services RoadbookRally reserves the right to modify, suspend, or discontinue the Services or any part of them, temporarily or permanently, with or without notice. You agree that RoadbookRally shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.
