Refund Policies and Administration

SIA Roadbook Rally (“RoadbookRally,” “we,” “us,” or “our”) is a global marketplace/platform for live experiences. We recognize the importance of setting clear purchase expectations that are fair to both event creators and consumers. Our Organizer Refund Policy Requirements establish the minimum standards for refund policies that organizers of paid events and tracks (“Organizers,” “you,” or “your”) must follow when hosting events or tracks on RoadbookRally. These requirements specify when you are expected to issue refunds and when we may issue refunds on your behalf, regardless of your stated refund policy.

Minimum Requirements

We understand that refund policies may vary based on the type of event and track and the Organizer. To provide flexibility, you may set your own refund policies for your RoadbookRally events and tracks, provided they meet the following minimum requirements:

(a) Refund policies must be posted on the applicable event page and/or supplementary regulations.

(b) "No refund" policies are allowed but must be clearly stated and comply with these minimum requirements, including providing for the Specified Refunds

(c) All refund policies (including "no refund" policies) must allow refunds for the situations specified in Specified Refunds.

(d) Refund policies must comply with all applicable local, state, provincial, national, and other laws, regulations, and rules, including those imposed by Card Schemes or Alternative Payment Frameworks.

(e) Refund policies must include clear instructions on how to request a refund, specifying the process, timeframe, and point of contact.

(f) Refund policies cannot be changed retroactively unless the change benefits impacted consumers by placing them in an equal or better position than they were under the original policy at the time of purchase.

(g) Refund policies must specify a response timeframe for refund requests, which should not exceed five (5) business days for an initial response.

(h) Refund policies must be fair and reasonable.

If a refund policy is missing or does not meet these minimum requirements, we may—but are not obligated to—modify it to ensure compliance. Modifications may include updating the refund policy on the event page or retroactively applying changes during a dispute, chargeback, or refund request.

Specified Refunds

(a) Mandatory Refunds Your refund policy must allow refunds in the following situations:

The event or track is canceled or not fully performed. The event or track is postponed and not rescheduled within 90 days of the postponement. These refunds must be initiated by you. If we issue these refunds on your behalf, we may use funds from your account (including from related or unrelated events) or invoice you directly to cover the costs.

(b) Additional Required Refunds Regardless of your posted refund policy, you must respond to all refund requests within five (5) business days and issue refunds to entry fee payers in the following cases:

We determine that the event or track fails to provide the advertised goods and services, including cases where the main advertised experience or component of the event/track is not delivered. The event/track description at the time of purchase significantly differs from the actual event/track. Attendees cannot attend due to your failure to plan for capacity, entry/exit logistics, or if attending would pose safety concerns. Attendees are unable to access the event/track venue. The refund request is eligible under your posted refund policy. These refunds must be initiated by you. However, as a limited payments agent, we may—but are not obligated to—process these refunds on your behalf if you fail to do so. We may use funds from your account (including from related or unrelated events) or invoice you directly to cover these refunds.

(c) Discretionary Refunds by RoadbookRally Additionally, we may—but are not obligated to—issue refunds on your behalf in the following situations, using funds in your account (including from related or unrelated events) or by invoicing you directly:

You specifically authorize the refund. You fail to respond to a refund request (by refunding or denying it) within five (5) business days. We determine that certain orders should be refunded based on your posted refund policy. We determine that your event violates our Terms of Service. We believe a refund is required under applicable laws, regulations, or Payment Scheme Rules. We determine that failing to issue the refund would result in a Chargeback that we are likely to lose. You fail to list a refund policy, and we determine that a refund would be reasonable. We identify fraudulent orders (e.g., purchases made with stolen credit cards or otherwise not bona fide transactions). We determine that an order is a duplicate. You engage in fraudulent activity or make misrepresentations. There is a substantial risk of nonperformance for the event/track or future events/tracks. There is a high likelihood of complaints, refund requests, transaction reversals, or Chargebacks for a significant number of orders. You are classified as a Prohibited Merchant, have processed Prohibited Transactions, or have hosted Prohibited Events/Tracks. We determine that failing to issue the refund would expose us to legal liability. These refunds may be initiated by us, but you remain fully responsible for all refund obligations. You must reimburse us for any refunds we process on your behalf, in accordance with the Merchant Agreement and these Organizer Refund Policy Requirements.

No Insurance or Guarantee

These Organizer Refund Policy Requirements do not obligate RoadbookRally to issue refunds under the circumstances described herein or in any other situation. They also do not require RoadbookRally to refund Event/Track Proceeds or RoadbookRally Fees.

All decisions made by RoadbookRally regarding these refund requirements—including, but not limited to, determining which orders qualify for refunds and the amount of any refund—are made at our sole discretion and are final and binding on both you and your consumers.

These Organizer Refund Policy Requirements do not serve as an offer to insure or guarantee an Organizer’s performance. Additionally, they do not guarantee that refunds will be issued in any particular situation.
